Contest Rules

Effective from March 11, 2024

Organizer
Unless otherwise stated in the contest, RockApart GmbH, Buchengasse 53, 1100 Vienna, hereinafter referred to as "RockApart" or "the Organizer," will act as the organizer.

1. Participation and Prize
1.1. Participation in the contest implies acceptance of the terms and conditions listed here.

1.2. Details about the prize and the course of the contest, such as the participation period or the type of prize, will be specified individually for each contest and communicated directly.

1.3. The selection and notification of the winner(s) will take place within five working days after the end of the participation period. If the prize is not accepted within three working days, it will be forfeited, and a new winner will be determined using a different procedure.

1.4. Winners agree that their name, contribution (e.g., a social media post), and the fact of their win, along with any potential photos, may be used and published by the Organizer for promotional purposes.

1.5. Eligible participants include:

1.5.1. Natural persons who register for the contest and meet the other conditions. Eligible participants are residents of Austria who are at least 18 years old at the time of participation.

1.5.2. Legal entities that register for the contest and meet the other conditions. RockApart assumes that by registering, the management's consent is given.

1.6. Notification will be sent via email or the relevant social media platform.

2. Partnerships
2.1. RockApart may organize contests in cooperation with partner companies, with RockApart acting as the Organizer. In such cases, partner companies may also be recipients of participants' personal data, as indicated in the contest's terms and conditions.

2.2. RockApart may also promote contests organized by other entities without being the Organizer itself. This will be clearly highlighted in the contest terms and conditions, and the partner company's terms and conditions will apply. RockApart is entitled to analyze personal data, regardless of the involvement of partner companies.

3. Social Media
3.1. For contests offered via social media platforms, RockApart acts as the Organizer. There is no connection to the respective social media platforms; they are neither sponsors, supporters, nor organizers of the contest. The guidelines of the social media platforms remain unaffected and additionally applicable. Participants may remove their contributions at any time.

4. Exclusion from the Contest, Termination, and Changes
4.1. The Organizer may exclude participants from the contest immediately if they violate the participation terms.

4.2. Employees of the Organizer and persons involved in the planning and execution of the contests are excluded from participation.

4.3. The Organizer reserves the right to terminate the contest without prior notice and for good cause. The contest may also be terminated due to force majeure or legal requirements.

5. Data Protection
5.1. Personal data will be processed by the Organizer in compliance with data protection regulations. They will not be published and will be used solely for conducting the contest and awarding the prize. After the prize has been awarded, the data of non-winning participants will be deleted. The data of winners will be stored for 7 years.

6. Data Security and Data Protection
6.1. Personal data collected as part of the contest will be treated with the utmost care by the Organizer, RockApart, in accordance with data protection laws. These data will be used exclusively for the conduct of the contest and will be deleted after the prize has been awarded, except for the data of the winners, which will be stored for seven years.

6.2. The personal data collected include:

Full name and email address of participants,
Details of contest participation,
Answers to contest questions,
Social media channels and usernames,
For winners, delivery addresses. In the case of partnerships, the relevant data may be shared with partner companies.

6.3. For business participation:

Companies register with a generic email address. If a personal email address is used, consent for data transfer must be secured, allowing RockApart to use it for the contest.

6.4. RockApart GmbH is responsible for data processing. For questions about data protection, participants can contact RockApart directly.

6.5. Participants have the right to information, rectification, deletion of their data, and can contact the Organizer directly with any questions in accordance with the General Data Protection Regulation.

6.6. Further information on data protection is available directly from RockApart.

7. Miscellaneous
7.1. Contests are exclusive and cannot be combined with other promotions. Prizes are personal and non-transferable.

7.2. The prize can be collected either at a location of the Organizer, at the contest site, or delivered by mail or email.

7.3. Any costs incurred by accepting and using the prize are borne by the participants.

7.4. Legal recourse is excluded.

7.5. Inquiries about contests should be directed to contact@rockapart.com.

7.6. If any conditions become invalid, the remaining provisions will remain effective. An appropriate regulation will be found that comes closest to the original purpose.

7.7. Austrian law applies.

7.8. In the event of disputes, the court in Vienna is responsible, unless otherwise required by law.
